A whistleblower is an individual within or outside an organization who reports of any misconduct either presently done or done in the past. The misconducts may either be financial or severe social issues.Whistleblowers are thus grouped as internal and external depending on whether they are in the organization or not and their aim is usually to improve on the governance if the organization. Whistle blowing promotes a healthy competition between competitors who many use unfair means to compete their competitors.
It also gives early warning over actions that can damage the integrity of an organization, it serves as an excellent tool to fight corruption.Whistleblowers lawThe law stipulates enough protection for the whistleblower and even his/her job, but reporting any employer may not go on well for the employee because the employer can fire the employee and even launch court cases which the employee may not meet their financial obligations against the organizations.The law protects employees against employers not willing to follow the whistleblower laws and aim at harassing them instead. Employers are as well refrained from engaging in any activities made unlawful by whistleblower laws. A worker is also protected against harassment and gives them the power to file lawsuits.Whistle blowing is sometimes very expensive in terms of staff times who are involved in collecting and gathering materials and information to act as the defense against the alleged case. The time and money wasted may have been put to use on other aims of the whistle blowing where not to be achieved.Benefits of the lawAlthough the law has its limits its passage sent message that any misconduct within the organization was not to go unnoticed and this will refrain individuals from exploiting organizations that have an impact on the public.
The law is made to enforce reinstatement and compensation for damages caused. Internal whistle blowing within an organization help employees to raise matters that are not being down right and in the process develop confidence within the organization.The whistleblower law at times forces organizations that find it hard to reform willingly to undergo reformation and disclose their programs.Weaknesses of whistleblower legislationA great weakness with whistleblower laws is that they cover the employee after the misconduct has been disclosed and investigations began. The accused has in the mean time accumulated enough evidence to cover-up the alleged case while as the employee is blocked and has no proper evidence to prove their case.Another weakness is that a lone employee is left on their own to case against powerful organizations that can pay huge sums of money to distort the evidence.
The case may also last for years and the individual employee is left poor.The Whistleblower laws is in most cases not focused because the original case reported but the law focuses on the whistleblowers and what to be done to them, thus the success of the laws is not achieved since the organizations reforms are never implemented to curb any future misconducts.The Whistle blowing policy is a noble idea that must be emphasized by most federal states and organizations that wish to be transparent in their operations, but the state of whistle blower law makes the whole concept not very promising. I thus advocate that the policy is given the attention it deserves, strengthen the law; provide enough financial support to those who unearth such operations within an organization.Personal security should also be provided in cases where the accused may turn against the whistleblower in attempts to harm them physically.ConclusionAlthough Whistle blowing is done in good faith its consequences are depressing to the concerned employee, the employers treat them very unfairly at times and even if they where to remain in the organization they may never realize any reforms in the organization and the issues that lead them to whistle blow may go on as if nothing happened and they will have no confidence to report the same again.The whistleblower legislation mainly gives an illusion that the whistleblower will be well protected but in actual sense that is not the case. Many countries have no whistleblower laws although they value and acknowledge whistle blowing as a means of minimizing social injustices.
At times the concept of whistle blowing may not be a serious concept because if an employee has ambitions to prosper within the organization they may chose to sit and watch all the wrong doings without alerting any relevant authorities.Reference:Alford, C.
